By booking an Adventure, you confirm that you have read, understood, and agree to these Terms. These Terms, along with our Privacy Policy and any other written information provided prior to booking confirmation, form the foundation of your contract with us.
1. THE BOOKING CONTRACT
A booking is confirmed, and a contract is established when the Misogi Way issues a written confirmation after receiving the required deposit. It is your responsibility to review the confirmation carefully and promptly inform Misogi Way of any errors or missing information. Ensure that all names match exactly as they appear in the relevant passport.
2. SPECIAL REQUIREMENTS
Please disclose any special requirements at the time of booking. While Misogi Way will make reasonable efforts to accommodate such requests, this may not always be feasible due to the nature of the destinations and the availability of alternatives beyond the planned itinerary. Limited mobility may restrict participation in certain activities. Food allergies and dietary restrictions must also be communicated at booking, but the Misogi Way cannot guarantee that all dietary needs can be met. Special requests or requirements are not part of these Terms or the contract with the Misogi Way, and Misogi Way is not responsible for any inability to accommodate them.
3. AGE REQUIREMENTS
Anyone under 18 on the first date of travel is considered a minor and must always be accompanied by an adult. One adult can accompany up to two minors.
All bookings involving a minor are subject to Misogi Way’s review and approval. If local laws require parental, guardian, or other consent for a minor to travel, the accompanying adult is responsible for obtaining all necessary consents, documentation, and ensuring both the adult and minor(s) comply with all legal travel requirements, including entering and exiting relevant countries or regions. Misogi Way is not liable for any fees, damages, or losses resulting from the failure to obtain these approvals.
Each adult booking with a minor is fully responsible for the minor's behavior, supervision, and wellbeing, and agrees to these Terms on behalf of the minor(s), including all risks and liabilities. Misogi Way does not provide care services for minors and disclaims any responsibility for chaperoning or supervising them.
4. MANDATORY INSURANCE REQUIREMENTS
You are required to have travel insurance with a minimum coverage of USD$200,000 for medical, evacuation, and repatriation expenses, covering all dates of travel with Misogi Way. This insurance must include personal injury and emergency medical expenses. It is strongly recommended that you extend your coverage to include cancellation, curtailment, and any other potential costs arising from loss, damage, injury, delay, or inconvenience during travel. Please note that insurance coverage is not included in the Adventure cost, and you must obtain separate coverage at your own expense. It is your responsibility to ensure you have adequate coverage and comply with the terms of your insurance plan. Additionally, you must inform your insurer of the type of travel, destinations, and activities included in your booking to ensure appropriate coverage.
5. FINAL PAYMENT & ACCEPTANCE OF BOOKING
The confirmation from Misogi Way will specify the final payment amount required for your booking. The balance for any booked products or services is due 60 days prior to the departure date of the first day of your Adventure. If full payment is not received by the due date, the Misogi Way may, at its discretion, either adjust the rate for the booking or treat it as canceled and retain the deposit as a cancellation fee. For bookings made less than 60 days before the departure date, full payment is required at the time of booking. If payment terms differ for any booked product or service, these will be communicated before booking and outlined in the relevant invoice.
Misogi Way is not responsible for any third-party fees or charges associated with payment transactions, including those from financial institutions, and will not refund such fees.
6. CANCELLATION BY THE PARTICIPANT BEFORE DEPARTURE
You may cancel your booking by notifying Misogi Way. Cancellation fees, if applicable, will be determined based on the date Misogi Ways receives your cancellation notice and are expressed below:
Cancellation of an Adventure:
(a) Cancellation received 60 days or more before departure of the first product or service in your booking: You may request a credit or refund.
(b) Cancellation received 30-59 days before departure of the first product or service in your booking: Cancellation fees will apply.
(c) Cancellation less than 30 days before departure of the first product or service in your booking: No refund will be provided.
The above cancellation conditions are a genuine estimate of the losses Misogi Way would incur if you cancel within the stated time, considering supplier charges (which can be up to 100%) and potential cost savings or income from redeployed travel services.
Important note: Some arrangements cannot be amended after confirmation, and any changes or cancellations may incur a charge up to 100% of the arrangement in addition to the fees above.
The Tour Operator will deduct the cancellation charges from any payments you’ve already made.
Cancellation Due to Unavoidable & Extraordinary Circumstances:
If "unavoidable and extraordinary circumstances" occur at your destination or nearby, significantly impacting the Adventure or transport arrangements, you may cancel without incurring a cancellation fee. In such cases, Misogi Way will refund all payments made but will not provide additional compensation. This applies if the Foreign and Commonwealth Office updates its travel advice to warn against travel to your destination after your booking. "Unavoidable and extraordinary circumstances" include events such as warfare, terrorism, serious health risks (e.g., disease outbreaks), or natural disasters (e.g., floods, earthquakes) that prevent safe travel to your destination.
6. DETAILS REQUIRED FOR BOOKING
To complete your booking, you must provide the information requested by the Misogi Way along with the final payment. Failure to provide the required details for air tickets, permits, or other inclusions may result in additional costs, fees, or the inability to secure those services, for which you will be responsible.
If you fail to supply the requested information, Misogi Way reserves the right to cancel your booking (or the affected part of it) and apply cancellation fees at its sole discretion. The specific information required will depend on the Adventure and will be communicated to you during the booking process.
Misogi Way is not liable for any fees, delays, or issues arising from errors, omissions, inaccuracies, or incomplete information you provide.
7. GUARANTEED DEPARTURES, CHANGES, AND CANCELLATIONS BY MISOGI WAY
An Adventure departure date becomes guaranteed once Misogi Way receives the minimum bookings confirmed secured by a valid deposit.
Misogi Way guarantees that all scheduled Adventure departures with a valid deposit will proceed as indicated on the confirmation, barring reasonable itinerary adjustments or health and safety concerns, as outlined in these Terms. This guarantee does not apply in cases of Force Majeure. Up-to-date Adventure and itinerary details are available on the Misogi Way website or by contacting them directly. Please note that brochures and printed materials are subject to updates and should not be solely relied upon for this guarantee.
Insignificant Changes
If minor changes to your booking occur, Misogi Way will make reasonable efforts to inform you as soon as possible, provided there is sufficient time before departure. However, Misogi Way is not liable for failing to provide advance notice of insignificant changes. Examples of insignificant changes include:
- Substituting accommodation with one of the same or higher standard.
- Changing carriers (e.g., services).
Significant Changes
Occasionally, Misogi Way may need to make major changes to your confirmed arrangements. Examples of significant changes include:
- A change in the accommodation location for all or most of your trip.
- A downgrade to accommodation of a lower standard or classification.
- Adjusting the departure time or trip duration by 12 hours or more.
- Omitting one or more destinations from the itinerary.
If a significant change or cancellation occurs, Misogi Way will inform you promptly and provide the following options:
1. Accept the changes.
2. Receive a full refund of all monies paid.
3. Choose alternative arrangements of comparable or higher standard (if available) at no extra cost.
4. Opt for alternative arrangements of a lower standard (if available) with a refund for the price difference.
You must notify Misogi Way of your decision within 7 days of receiving the offer. If no response is received within 7 days, Misogi Way will follow up.
Post-Departure Changes
Once the Tour has started, unforeseen circumstances, operational concerns, or issues related to health, safety, enjoyment, or comfort may necessitate itinerary changes. Such decisions are made at Misogi Way’s discretion. You acknowledge that incidental expenses arising from such changes are your responsibility, and Misogi Way is not liable for your failure to prepare for unexpected events.
Compensation
If Misogi Way cancels your booking or makes a significant change less than 60 days before departure and you reject the changes or alternatives, you will receive a full refund.
Compensation will not be provided in the following cases:
- Insignificant changes.
- Changes or cancellations more than 60 days before departure.
- Acceptance of significant changes or alternative arrangements.
- Cancellations due to your failure to make timely payments.
- Changes requested by you.
- Cancellations or changes due to Force Majeure.
If a significant portion of your trip cannot be delivered after departure, Misogi Way will attempt to arrange suitable alternatives at no extra cost. If the alternative arrangements are of a lower standard, an appropriate price reduction will be provided.
8. TRAVEL DOCUMENTS
You are solely responsible for obtaining and carrying all necessary documentation and identification for entry, departure, and travel to each destination on your itinerary. This includes a valid passport, as well as any visas, permits, certificates (such as vaccination or medical certificates), and insurance policies required by relevant authorities. Your passport must remain valid for at least six months beyond the final date of travel with Misogi Way as stated in your itinerary.
It is your responsibility to secure all required documents, visas, and permits before the Adventure begins. You will bear all costs associated with missing, invalid, or incomplete documentation. Additionally, you are fully liable for any expenses or losses incurred by Misogi Way due to your failure to obtain or possess the necessary travel documents.
Misogi Way does not offer advice on travel documentation and provides no guarantees regarding the accuracy or completeness of information on visas, vaccinations, climate, clothing, baggage, or special equipment. You acknowledge that any errors or omissions in this information are not the responsibility of Misogi Way.
9. FLEXIBILITY & UNUSED SERVICES
You acknowledge that adventure travel inherently requires flexibility and agree to allow Misogi Way to make reasonable changes to products, services, or itineraries as needed. Routes, schedules, accommodations, activities, amenities, and modes of transportation may be adjusted without prior notice due to unforeseen circumstances or events beyond Misogi Way's control. These may include but are not limited to, Force Majeure, illness, mechanical issues, flight cancellations, strikes, political events, or border and entry restrictions.
No reimbursements, discounts, or refunds will be provided for services missed or unused after departure if Misogi Way is not at fault. This includes situations where you are removed from an Adventure due to negligence or a violation of these Terms.
10. CHANGES MADE BY YOU & TRANSFERS OF BOOKING
Changes Made by You
If you wish to amend any aspect of your booking after receiving the confirmation invoice, you must notify Misogi Way in writing as soon as possible. This notification must come from the person listed as the primary contact on the booking. It is your responsibility to ensure that the information provided to Misogi Way is accurate and up-to-date. Any name changes or other modifications to a booking are subject to Misogi Way’s approval, availability, and these Terms.
Any additional costs incurred due to the changes, along with an administrative fee, will be charged to you. Be aware that these costs may increase as the departure date approaches. Changes within 10 days of departure are not permitted. If changes cannot be accommodated and you choose not to proceed with the original booking, it will be treated as a cancellation and cancellation fees may apply. Note that cancellations of any Adventure, product, or service are not considered changes and will follow the applicable cancellation terms.
Transfer of Booking
If you or a member of your group is unable to travel, their place may be transferred to another person, provided the following conditions are met:
a) The replacement traveler is introduced by you and meets all applicable requirements for the trip.
b) Notification is given to Misogi Way at least 7 days before departure.
c) All outstanding balances, an amendment fee of USD $50 or equivalent (depending on your booking currency), and any additional costs resulting from the transfer are paid.
d) The transferee accepts these booking conditions and all other terms of the original contract.
You and the transferee will be jointly and severally liable for all payments. If no replacement is found, cancellation charges as outlined in clause 6 will apply. No refunds will be provided for unused services or travelers who do not attend.
Important Note:
Certain arrangements may require a longer notice period or may not be eligible for amendments or transfers once confirmed. In such cases, changes could result in cancellation charges of up to 100% of the affected arrangements.
11. ACCEPTANCE OF RISK
You acknowledge that adventure travel and the products and services offered by Misogi Way may involve a significant amount of risk to your health and safety. By traveling with Misogi Way you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release Misogi Way from all claims and causes of action arising from any losses, damages, or injuries, or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Adventure itineraries or otherwise offered by Misogi Way. Misogi Way requires that you confirm your assumption of this responsibility by completing the participation waiver (the “Waiver”) prior to departing on your Adventure. You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure. Standards of hygiene, accommodation and transport in certain countries where Adventures take place are often lower than the standards you may reasonably expect in your home country or region. You agree that Misogi Way is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where an Adventure, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on an Adventure or, if in the opinion of Misogi Way (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, Misogi Way may terminate your travel arrangements on any product or service immediately at your expense and without any liability on Misogi Way’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.
You are responsible for any costs (including repair, replacement and cleaning fees) incurred by Misogi Way or the Tour Operator’s suppliers for property damage, destruction or theft caused by you while on an Adventure. You agree to immediately report any pre-existing damage to a representative of the Tour Operator and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.
You agree to take all prudent measures in relation to your own safety while on an Adventure including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither the Misogi Way nor its Third Party Suppliers are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
You agree to bring any complaints to Misogi Way as soon as possible in order to provide Misogi Wat with the opportunity to properly address your complaint. You agree to inform your tour leader, another representative of Misogi Way or Misogi Way’s customer service department directly. Misogi Way assumes no liability for complaints that are not properly brought to the attention of Misogi Way and cannot resolve or attempt to resolve complaints until proper notice is provided. If you fail to notify Misogi Way of complaints or concerns while on an Adventure, Misogi Way will be deprived of the opportunity to investigate and rectify your complaint immediately and this may affect your rights under these Terms. Any complaint made after the completion of an Adventure must be received in writing by Misogi Way within 30 days of the last day of travel of the booking in question.
12. OPTIONAL EXTRAS
"Optional Extras" refer to any activity, transportation, meal, product, or service not explicitly included in the Adventure itinerary or price and not forming part of the package. You acknowledge that any assistance provided by the Misogi Way’s representative(s) in arranging, selecting, or booking Optional Extras is done solely at your request. Misogi Way makes no guarantees and expressly disclaims all liability for any issues arising from participation in Optional Extras or any information provided by its representatives regarding such services.
By participating in or booking Optional Extras, you release Misogi Way from all claims and liabilities related to damages, loss of enjoyment, inconvenience, or injuries incurred.
You further agree that any responsibility for loss, damages, death, personal injury, illness, emotional distress, mental suffering, psychological injury, or property damage associated with Optional Extras rests entirely with the third party providing the service or activity.
13. FORCE MAJEURE
Unless explicitly stated otherwise in these Terms, Misogi Way is not liable for or obligated to compensate you if its contractual duties are impacted by "unavoidable and extraordinary circumstances." This refers to events beyond Misogi Way’s control, where the consequences could not have been prevented despite taking all reasonable measures. Examples include, but are not limited to, warfare, acts or threats of terrorism, civil unrest, labor disputes, government interference, political instability, significant health risks such as disease outbreaks at the travel destination, or natural disasters like floods, earthquakes, or adverse weather that make travel unsafe. Additional examples include actions by national or local authorities (including port or river authorities), industrial disputes, lock closures, natural or nuclear disasters, fires, chemical or biological incidents, unavoidable technical issues with transport, and other similar events outside the control of Misogi Way or its suppliers.
14. IMAGES AND MARKETING
By participating in any Adventure, you acknowledge that images, photos, or videos featuring you may be captured by other participants, Misogi Way, or its representatives. You consent to the taking of such images and grant Misogi Way, its contractors, sub-contractors, and assigns, a perpetual, royalty-free, worldwide, and irrevocable license to use, reproduce, and distribute these images for any purpose, including marketing, promotions, and the creation of promotional materials. This applies across all current and future mediums, without any further obligation or compensation to you.
15. PRIVACY POLICY
To provide the Adventure and any related products or services, Misogi Way must collect your personal information. The information gathered is limited to what is reasonably necessary for Misogi Way and its Third Party Suppliers to deliver the specific Adventure, products, and services you have requested. Details on how your information is collected, used, and disclosed are outlined in the Tour Operator’s Privacy Policy, which is available at [http://www.gadventures.com/terms-conditions/privacy/](http://www.gadventures.com/terms-conditions/privacy/) and is incorporated into these Terms. By providing your personal information to the Tour Operator, you acknowledge and accept the terms outlined in the Privacy Policy.
16. AMENDMENTS
Misogi Way reserves the right to update or alter these Terms at any time, and will post the amended Terms on Misogi Way’s website at gadventures.com/terms-conditions/. You are deemed to have accepted any amendments to these Terms on the date that is 10 days after their posting on the Misogi Way’s website. We recommends that you refer to the Terms prior to travel to familiarize yourself with the most up-to-date version available.
